Terms and Conditions

ENTIRE AGREEMENT

This agreement contains the full understanding between JnK Imagery and the Client. It supersedes all prior discussions or agreements. Any changes must be made in writing and signed by both parties.

RESERVATION & PAYMENT

A signed contract and non-refundable retainer are required to secure the session date and the selected Ultimate Headshot package, which includes:

• Your Get Ready Guide - to help you prepare for your session.
• Complimentary professional makeup (light grooming for men) and light hairstyle touch-ups to ensure you look polished and camera-ready! 
• A 1-hour guided studio session with up to 4 wardrobe and backdrop changes.
• Same-day image selection: choose 3 of your favourite images, which will be professionally retouched and delivered to you digitally within 1 week. 

*Additional images can be purchased within 6 months of your session.

If the Client cancels, postpones, or breaches the contract, the retainer is forfeited as liquidated damages. The Client is responsible for reimbursing any pre-session expenses already incurred (e.g., makeup artist deposits, props, studio rentals).

Late Payments

Any invoice that remains unpaid 60 days past the due date will incur a 10% late fee, applied to the outstanding balance. Continued non-payment may result in the pause of all work and withholding of image delivery until accounts are settled.

COPYRIGHT & USAGE

Photographer Rights:
JnK Imagery retains full copyright to all images, including all original and edited files.

Client Rights:
The Client may use the delivered images for business and promotional purposes, including on websites, in printed materials, on social media, on signage, and in media distribution.

Photographer Usage:
JnK Imagery may use images for promotional, marketing, portfolio, educational, and competition purposes.

Indemnification:
The Client agrees to indemnify and hold harmless JnK Imagery from any third-party claims resulting from the Client’s use of the images.

ARTIFICIAL INTELLIGENCE (AI) USE

The Client may not upload, submit, or provide any images created by JnK Imagery to AI systems or machine learning models for training, dataset inclusion, or image generation.
The Client may not use AI tools to create derivative works, synthetic versions of themselves, composites, or altered portraits based on JnK Imagery’s work without written permission.
Minor editing apps are permitted. AI-generated alterations are not.

CANCELLATION, POSTPONEMENT & RESCHEDULING

The Client may reschedule once with a minimum of 72 hours’ written notice. Additional reschedules or notice given with less than 72 hours ' notice may result in a $150 rescheduling fee to secure the new date.

Exceptions:
Fees may be waived at JnK Imagery's discretion in the case of genuine emergencies or illness.

If the JnK Imagery is unable to fulfill the agreement due to illness, emergency, mechanical failure, natural disaster, pandemic, government order, or circumstances beyond its control, liability is limited to the return of all payments made. 

Sessions must be rebooked within 30 days unless otherwise mutually agreed.

WORKING ENVIRONMENT & SAFETY

JnK Imagery operates in compliance with all applicable laws and safety standards. JnK Imagery is not required to conduct the session if doing so would violate governmental restrictions or create unsafe conditions.

JnK Imagery may end the session if the environment, location, or individuals present compromise safety or well-being.

EXCLUSIVITY & SUBSTITUTION

JnK Imagery will be the exclusive photographer for the session.
JnK Imagery may substitute materials, services, or photographers if needed, provided the quality remains consistent with studio standards.

RE-SHOOTS

If the Client is dissatisfied with the final images solely due to personal preference, a re-shoot may be booked at 25% off the original session fee.
Digital files from the first session are not included in this discounted re-shoot.

If images are unusable due to technical issues (e.g., equipment failure), JnK Imagery will re-shoot at no cost.

CLIENT COOPERATION & NO-SHOWS

JnK Imagery is not responsible for missed images, lack of variety, or limited results due to the Client’s lateness, lack of preparation, or unwillingness to participate.

If the Client or required individuals fail to appear for the scheduled session:
• the retainer is forfeited, and
• Rescheduling requires a new 50% deposit and agreement on a new date.

WEATHER

If weather prevents an outdoor session from taking place safely or effectively, both parties will reschedule at the earliest mutually available date at no additional charge.

MODEL RELEASE

The Client grants JnK Imagery the right to use images featuring the Client, their business, or any participating individuals for promotional, editorial, advertising, and portfolio purposes in any medium.

The Client releases JnK Imagery from any related claims or liability.

EXHIBITION

The Client grants JnK Imagery permission to display selected images as examples of JnK Imagery's work, including competition submissions. The Client waives any claims to profits from such uses.

This agreement becomes effective upon signature by both parties.
